1. Acceptance
By accessing or using the Platform, you agree to these Terms of Use in full.
2. Description of Service
- A free directory and deep-link hub for Martha’s Vineyard and Nantucket (ferries, bike rentals, restaurants, events, activities, shopping, weather).
- Optional paid features: downloadable itineraries, curated reservation-required restaurant access, and a premium personalized concierge service.
- Optional tour bookings facilitated through our booking partner, FareHarbor, and participating tour operators.
- An AI-assisted “Build My Itinerary” tool generating suggestions from content already published on the Platform.
3. Third-Party Links Are Not Part of the Platform
Once you click a FareHarbor, tour-operator, ferry, restaurant, or other affiliate/booking-partner link and leave the508islandconcierge.com, you are leaving our platform entirely. Topchiyska Enterprises LLC and The 508 Island Concierge do not process, host, control, or have any access to bookings, payments, cancellations, refunds, personal data, or customer support handled on that third-party site. This applies equally to ferry company sites, Resy/OpenTable, individual business websites, and any other outbound link.
- We are not a party to, and assume no responsibility for, any transaction, contract, booking, or dispute between you and a third party.
- Any issue involving a booking made off-Platform — including refunds, cancellations, rescheduling, no-shows, billing errors, or data handling — must be resolved directly with that third party.
4. Payment & Purchases (On-Platform Only)
- Prices for on-Platform paid features are listed at time of purchase and may change.
- Payment is processed by “Stripe”.
- This section governs only purchases made directly through the508islandconcierge.com — not bookings completed on FareHarbor, a tour operator’s site, Resy, OpenTable, or a ferry company’s site.
5. User Conduct
- No scraping, harvesting, or automated extraction of Platform content.
- No reverse engineering or reselling of Platform access or paid content.
- No impersonating the Company, its staff, or any listed or booking-partner business.
- No unlawful, fraudulent, or abusive use of the Platform.
6. Intellectual Property
All Platform content, design, and branding are owned by or licensed to Topchiyska Enterprises LLC, except third-party trademarks/content, which remain property of their owners.
7. Disclaimers
The Platform and its content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, including accuracy, availability, or fitness for a particular purpose. We do not warrant that third-party listings, links, or booking partners will be accurate, available, uninterrupted, or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, Topchiyska Enterprises LLC and The 508 Island Concierge are not liable for any direct, indirect, incidental, special, or consequential damages arising from: (a) your use of the Platform; (b) any third-party website, business, ferry, restaurant, or tour operator linked from the Platform; (c) any booking, payment, refund, cancellation, technical issue, or data practice occurring on FareHarbor or any other third-party platform after you leave the508islandconcierge.com.
9. Indemnification
You agree to indemnify and hold harmless Topchiyska Enterprises LLC from claims arising out of your use of the Platform or any third-party service accessed through it, to the extent permitted by law.
10. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. [Confirm venue/jurisdiction with counsel.]
11. Termination
We may suspend or terminate access for violation of these Terms or the Acceptable Use Policy.
12. Changes
We may update these Terms; continued use after changes constitutes acceptance.
